By using the site and any of our services you signify your acceptance of the following terms and conditions:

These Terms and Conditions shall apply to the agreement between

The individual or company applying for the provision of services by Big Button Media ("the Customer").

GENERAL DEFINITIONS:

"We", "Us", "The Company" shall refer to the provider of the service: Big Button Media Limited, 13-15 Fazeley Studios, 191 Fazeley Street, Birmingham B5 5SE.

"You", "Your", "The Customer", "The Client" shall refer to the individual or company applying for the provision of services by Big Button Media Ltd.

MailerMate or the "Services", "Service","Site" or "System" is a software as service solution provided by Big Button Media Limited.
By using the site and any of our services you signify your acceptance of the following terms and conditions:

You shall not:

1.1 use the Services in any way so as to bring the Services or MailerMate into disrepute;

1.2 use the Services to send unsolicited or unauthorised advertising, promotional material, 'junk mail', 'spam', chain letters or pyramid Schemes, offensive adult services, pornographic material, pornographic images, communications promoting email address data lists or any other form of solicitation to any data subjects or third party;

1.3 forge headers or otherwise manipulate identifiers in order to disguise the origin of any content or materials transmitted through the MailerMate Services;

1.4 use MailerMate in a manner which is unlawful, harmful, threatening, abusive, harassing, tortuous, indecent, obscene, libellous, menacing or invasive of another persons privacy;

1.5 use the Services in a manner which infringes the Intellectual Property, proprietary or personal rights of any third party;

1.6 misuse the Site by introducing viruses, trojans, worms, logic bombs or other material which is technologically harmful;

1.7 attempt to gain unauthorised access to the Site or Services, the server on which the Site or Services are stored or any server, computer or database connected to the Site or Services;

1.8 attack any site or system via a denial-of-service attack or a distributed denial-of service attack.

2. We reserve the right monitor the content of emails created and/or sent using MailerMate. Emails in breach of any of the above are not permitted and offending accounts will be closed without notice.

3. Liability. You shall:

3.1 Fully indemnify and keep indemnified Big Button Media Limited against any losses, claims, fines, damage or expenses (including reasonable legal and professional expenses) (whether direct, indirect or consequential) arising as a result of or in connection with any use of this service.

LEVEL OF SERVICE

4.1 Big Button Media will use all reasonable endeavours to deliver content to end-users. However, we cannot and will not guarantee 100% uptime of the Service. Disruption of service to an end-user may be due to network congestion or other disruptions on the Internet that are not related to the Service provided by Big Button Media. Therefore Big Button Media will make every effort to provide an efficient and constant service, but cannot guarantee that the Service and or connection be maintained at all times.

4.2 Due to the huge combination of hardware and software available, we cannot guarantee all web browsers, operating systems and mail clients are supported and we do not make any warranty, expressed or implied about the delivery of your content.

ACCEPTABLE USE POLICY

5.1 Email campaigns must only be sent to "opted in" lists, which you have compiled during business with your clients

5.2 The use of bought or rented mailing lists is prohibited and offending accounts will be closed without appeal
